Private disposals and the 365-day rule
Portugal generally applies 28% to the positive taxable balance of private crypto gains and losses, with an option for resident taxpayers to aggregate relevant income instead. Non-security cryptoassets held for at least 365 days can fall outside this charge; losses on those excluded disposals are excluded too. This is a holding-period rule, not a seven-year new-arrival concession.
The specific regime excludes unique, non-fungible cryptoassets from its definition, and securities tokens need their own classification. The holding and crypto-to-crypto deferral provisions also contain tax-cooperation conditions concerning the parties’ jurisdictions. A transaction involving an unidentified decentralised counterparty needs advice rather than an assumed exemption.
Rewards, losses and practical limits
Issuance, mining and validation can be business or professional activities. Capital remuneration can be another category. The simplified-business coefficients sometimes advertised as 15% and 95% are proportions used to calculate taxable income, not final tax rates.
Qualifying non-excluded losses may be carried forward for five years where aggregation is elected, subject to the rules; losses connected with preferential-tax jurisdictions can be restricted. High-income mandatory aggregation in Article 72 concerns relevant securities disposals, not automatically every non-security crypto gain.
Check the exit as well as the arrival
Losing Portuguese tax residence is treated as a disposal for this regime. Test the holding-period exclusion, values and any other applicable relief at departure; it is unsafe either to promise no exit charge or to say every departure is taxed. Cost and transaction history should therefore be retained even during years when a sale is excluded.
