A real current crypto concession

Ministerial Regulation 399, published in September 2025, added clause 109 to Regulation 126. It exempts gains above investment cost from qualifying cryptocurrency or digital-token transfers through licensed exchanges, brokers or dealers for income received from 1 January 2025 through 31 December 2029. No holding-period minimum appears in that provision. The calendar window is not reset by moving to Thailand.

Check the exact operating entity

Consult the SEC licence register for the provider and relevant crypto/token licence. Transfer routing, the legal counterparty and the receipt date need evidence. A familiar exchange name is not proof that a transaction used its qualifying Thai entity.

For a crypto-to-crypto swap, verify that the transaction is a covered transfer through the licensed channel; do not treat all DeFi or offshore swaps as exempt merely because the token is traded elsewhere on a Thai exchange.

Activity income and the position after the window

The concession concerns transfer benefits above invested cost. It should not be expanded automatically to staking yield, mining rewards, salaries or other service income. Ordinary personal income tax is progressive up to 35%; treatment outside the exemption needs classification and calculation. The 2029 end date calls for an exit or continuation plan.

Residence and remitted foreign income

Section 41 uses 180 days or more in a tax year for residence. Revenue Department guidance says foreign income arising from 2024 while resident can be taxable when remitted, including in a later year. Income earned before 2024 and foreign income earned while non-resident are separately addressed. Locate the source of crypto receipts rather than assuming a foreign exchange settles it.

LTR: useful but not a universal crypto visa

BOI describes overseas-income exemption for Wealthy Global Citizens, Wealthy Pensioners and Work-from-Thailand Professionals. Highly Skilled Professionals instead have a 17% concession limited to qualifying employment income. LTR permission is initially five years, extendable for five more if conditions remain satisfied. Qualification, income source and the applicable tax instrument must be checked separately.
